Alleged repeat rapist denied bail

WINDHOEK, 18 DEC (NAMPA) – The case of a young man accused of the brutal rape of a 9-year-old girl in Otjomuise in October, was on Tuesday postponed to 12 March 2019 for legal aid application and further police investigations.
Gervin Gawanab, 20, who is in custody for rape and intention to cause grievous bodily harm, appeared on Tuesday before Magistrate Atutala Shikalepo in the Katutura Magistrate’s Court, who denied his request for bail.
The accused last appeared in connection with the matter on 05 December 2018. His case was also postponed for additional instructions from the Office of the Prosecutor-General (PG).
The magistrate said the court already received nine instructions from the PG, including instructions regarding Gawanab’s other pending matters.
Shikalepo said the State denied him bail as he has other pending matters of the same nature, is a danger to society and that it will not be in the interest of justice to grant him bail.
There is a fear that he will interfere with the pending cases, she added.
During his earlier appearance, the accused indicated that he will not apply for legal aid and wished to conduct his own defence, but changed his mind during Tuesday’s appearance.
“You are facing a serious charge and legal aid will be in your best interest,” noted the magistrate.
Gawanab, who was arrested on 29 October 2018 after allegedly raping the 9-year-old girl in Otjomuise’s 7de Laan, in total has four rape cases to his name.
He has also been charged with three cases in which he is facing counts of assault with intent to do grievous bodily harm.
