Man sentenced for indecent sexual assault of toddler

KATIMA MULILO, 20 SEP (NAMPA) – A 26-year-old man has been sentenced to three years of confinement for the sexual assault of a minor at Katima Mulilo in 2013.
Cretius Lubanda Muhita, who was 24 years old when he was nabbed for the alleged rape and indecent sexual assault of a three-year-old girl, was last Tuesday also handed a fine of N.dollars 2 000 or 12 months’ imprisonment by the Katima Mulilo Regional Court.
Magistrate Bongani Ndlovu sentenced Muhita, who was found not guilty on the rape charge, but guilty of indecent sexual assault.
The crime happened in the victim’s parents’ house, where Muhita also lived, on 26 December 2013.
According to a written plea statement bearing Muhita’s signature, he confessed that on the night of the incident, he was heavily inebriated and when he arrived home, he found the victim in the corridor.
He then called the toddler to his room and rubbed his genitals against the baby’s thighs.
“I admit that at that material time, I knew that by rubbing my genitals against her thighs, I was performing an indecent act that was not only wrong but also unlawful, and that I could be punished for it,” reads Muhita’s plea statement.
In his sentencing, Ndlovu said the charges the Grade 9 high school drop-out faced were of a serious nature and that he deserves to be punished.
Although a first-time offender, Ndlovu said Muhita is a misfit, and if not managed now, he will return to the same courtroom facing more serious offenses.
“It is fortunate this child was not raped. This matter is a serious offence and the accused needs to be punished to deter would-be offenders,” Ndlovu said.
