Confessions in rape trial admissible before court

WINDHOEK, 19 SEP (NAMPA) - A young resident of Okahandja arrested in October 2010 after he allegedly attacked and sexually assaulted three girls, suffered a heavy blow when his self-incriminating statements were admitted as evidence before court on Monday.
These statements and other related confessions by Rudolf Goagoseb, 24, were ruled admissible in a judgement handed down by Acting High Court Judge Boas Usiku at the end of the hearing of a trial within a trial on Monday.
The statements and confessions will now be used against the accused in the main trial which resumes on Tuesday.
Goagoseb allegedly sexually assaulted three minor girls when he was 18 years old in October 2010.
He denied any involvement and entered a plea of not guilty when the trial started in August 2016.
During the trial within a trial, Goagoseb strongly disputed the confessions and statements, claiming that the Police investigating officers had forced him to make such statements.
He also claimed that he was not properly informed about the right to have a legal representative present when making the statements.
However, prosecution proved beyond reasonable doubt that the confessions and other statements were made voluntarily and freely, and were thus ruled admissible before court to be used as evidence against him.
Goagoseb faces five counts of rape, two counts of assault with intent to cause grievous bodily harm and attempted murder.
He allegedly raped two of the minor girls twice.
A summary of substantial facts contained in the charge sheet has it that accused Goagoseb was arrested at the beginning of October 2010, shortly after he allegedly violently attacked and sexually molested three minor schoolgirls, aged between 12 and 14.
He allegedly attacked the girls while they were walking through a bushy area near Okahandja's Nau Aib residential area.
Goagoseb, allegedly armed with a broken glass bottle, threatened the girls and tied up their hands before forcing them to perform sexual acts on him.
He allegedly violently raped the 12-year-old girl, who was found naked and bleeding. The girl had to receive medical treatment at the Okahandja State Hospital for the injuries she sustained.
Goagoseb was free on bail on a charge of rape when he allegedly violently attacked and sexually molested the victims.
He is now in custody at the Windhoek Correctional Facility.
