KUALA LUMPUR, July 10 (Bernama) -- A proposal to set up the Independent Police Complaints and Misconduct Commission (IPCMC) was rejected by the government because its drafting had breached every principle of justice resulting in bad law, said Deputy Home Minister Datuk Wan Junaidi Tuanku Jaafar.
"It (IPCMC would) breaches everything, the constitution, natural justice, it excludes the power of the court. It becomes the final adjudicator," he told reporters at the Parliament lobby here today.
"Any decision made by the IPCMC must be final and you cannot appeal in court. Have you heard of that kind of law?," he asked, noting that it would result in policemen being treated worse than criminals.
In the wake of reports of several custodial deaths recently, several quarters, including opposition politicians, have called on the government to implement the IPCMC, which was initially proposed a few years ago.
Elaborating, Wan Junaidi said, among others, it would take away the powers of the attorney-general as the sole prosecutor, as well as those of the inspector-general of police.
