SWAKOPMUND, 05 JUL (NAMPA) – Three young men from Swakopmund have to spend a combined seven years and six months behind bars for a mobile phone robbery here in November 2012.
Elvis Huiseb, 19, Elmut Naruseb, 22, and Stephanus Howaseb, 21 received the sentences when they appeared before Magistrate Ileni Velikoshi in the Swakopmund Magistrate’s Court on Thursday.
They were sentenced for robbing Valencia Gaoes off her BlackBerry mobile phone worth N.dollars 2 500 on the evening of 24 November 2012 in the Mondesa residential area.
Huiseb was also accused of touching and squeezing the victim’s breasts and genitals.
Huiseb denied having done such.
On count one of robbery, Huiseb received three years’ imprisonment, of which one year is suspended for five years on condition that he will not be convicted of a similar offence during that time.
The magistrate further sentenced Huiseb to 18 months’ direct imprisonment for indecent assault.
Naruseb was sentenced to three years in jail for robbery, of which one year and six months was suspended for five years.
Howaseb received three years for the same offence, with six months suspended for a period of five years.
In his verdict Velikoshi stated that before sentencing, the court took into account the fact that Huiseb spend a year and one month in jail, Naruseb a year and seven months, and Howaseb seven months awaiting trial.
Court records indicate that on the evening of the incident, Huiseb threatened to cut off the complainant’s arm with a machete if she refuses to follow his orders.
“Who carries a panga around in public, who does that? I understand you were coming from Heroes’ Bar, but what was the purpose of the panga?” the magistrate questioned Huiseb.
Two other men who were implicated in the same robbery were acquitted.
State Prosecutor Erastus Hatutale represented the State in this matter.
The accused persons conducted their own defence.
